En Banc?

En Banc again?  Christ, Lanny - are you a slow learner or what? You didn't get the time of day last time, what will be different this time?  Ah . . . , well, I think this time instead of getting a denial in a week it will take years!   What better way to avoid the remand than to put in the stall again?  Hey, this case could continue for two decades before it's through?  For what it is worth, I have to put this one in Word Perfect and it will probably screw up a few items.  My attempt to convert it to Word was a disaster - so we are stuck with this! If it comes out really bad - I will place it as a PDF file (yes, the Executive Session transcript will be available before the 6th Circuit denies the Motion for Rehearing En Banc!). Cross your fingers and here goes?

Nope, didn't work in WP or Word - back to the drawing board - PDF I hope? The Motion for Rehearing En Banc.

Yo Petie - you just the most corrupt judge on the block or the stupidest?  Don't have jurisdiction of a 153(q) case when the Award itself tells you they had no jurisdicition?  Isn't that fraud per se?  See you in Court soon!  Best Question ever:

The Court:  Mr. Boyt - Did Mr. Smoot give you what "appeared" to be a copy of the Executive Session Transcript at the Atlanta Regional Meeting in August of 1997?

Mr. Boyt: No, he gave me a copy of the Atlanta Edition of the El Paso Express!

The Court: But could it have "appeared" to be a copy of the Executive Session Transcript to a casual observor?

Mr. Boyt: I suppose it could, your Honor.

The Court:  $100,000 in punitive damages affirmed!

I love the American system of Justice!   Hell, I risked my life for it in Vietnam and Laos (allegedly)! Ah . . . , based upon what you (Petie) and the 6th Circuit have done to Smoot, I assure you I will never fight for my Country again unless it is in defense of my Family on home soil!

Hang in there and always have a nice day!
