Smoot over? Not hardly. As I
have stated for years, the Smoot Cases have the potential to be financial ruin for the UTU
because of the malicious prosecution and abuse of process perpetrated by President Little
and General Counsel Miller. Smoot's lawyer, Mr. Terry Green of Toledo, is currently
being sued for malpractice for his "behind closed doors" (the judge's chambers)
sellout of Smoot and that will be favorably resolved for Ken. The numerous appeals,
objected to by UTU and CSXT and having been denied, will start again in the Sixth Circuit
as soon as the bankruptcy court issues its rulings. The Bankruptcy Court still pending?
Can't be according to those Special Reps who say the case is over. However, click
below and put Smoot, Kenneth R. in the Search field and then click on docket info or where
ever "u" can! These cases are not over; Smoot and those that support
justice have not yet begun to fight! Yogi said it best: "it ain't over til its
over" and I can assure you, on my mother's grave, that the Fat Lady hasn't sung yet!

Soon after my second defeat at the
Chicago Convention, a joyous Earley supporter commented something to the effect that I
guess they didn't fall for that Vietnam bullshit again, were you even in the army? I think
I said something like no, I went to Canada like you. Funny how fast that smile left his
face. But, despite everything that happened in Chicago, I left with my head held
high and I have no regrets about that Convention. However, it occurs to me you would have
to have some audacity to claim you were in Vietnam if you weren't. Hell, I even think that
would be worse than lying about suing the union. In any event, to that asshole in
Chicago, a big hello from Lancer 13!

partipated in every day of Lam Son 719 except the two days off I got after I was shot down
in Laos. Warrant Officer Gary Witty picked up me and my crew and took several hundred
rounds in his ship. He received a Silver Star. He also saved my life and the lives of my
crew. Thanks again Gary.
